Supreme Court halts destruction of mobile phones found in exam halls

The Supreme Court has issued an interim order not to destroy mobile phones found in examination halls and the data contained within them. This order was issued by a single bench of Justice Shrikant Paudel during the hearing of a writ petition filed by advocate Anil Kumar Sah.

The court has instructed the Home Ministry to provide a written explanation within 15 days, detailing why the order should not be issued as per the petitioner’s demand.

The order specifies that until the final decision on the petition is made, the District Administration Office in Siraha should not confiscate or destroy the mobile phones and data found in examination halls, as mentioned in the notice issued on 2082 Jestha 13.

The court stated that an interim order was issued under Rule 49 of the Supreme Court Regulations, 2074, as immediate destruction of the mobiles and data could cause irreparable damage in terms of convenience and balance.

The court has also directed that the concerned parties be informed about the order.
