SC Asks Nepal Army to produce ‘officers in custody’ within three days

Kathmandu: The Supreme Court has ordered the Nepal army to produce two senior officers charged with conspiracy and ‘mutiny’ before the court within three days.

A single bench of the apex court comprising Justice Hari Phuyal today ordered that Col. Mahendra Shah and Lt.Col Kuldeep Timalsina be produced before the court within the next three days.

The two have been held in custody by the Army and framed for ‘conspiracy and mutiny’ that if proved will not only disqualify the duo from service, but also face life term since the constitution has abolished capital punishment.

Shova Karki, advocate and wife of Col. Shah had filed the habeas corpus seeking release of the two officers who were taken into custody and had pleaded that the two officers be produced before the court within 24 hours along with the ‘original file’ prepared by the Army charging them of plotting for mutiny.

Col. Shah and Lt. Col Timalsina had been arrested and taken into custody by the Military police.
