Human rights commission unable to identify shooter in Gen Z protests

The National Human Rights Commission has stated that it has been unable to determine who fired the shots during the Gen Z movement on Bhadra 23 and 24 last year.

Speaking at a program organized at the central office of the Nepali Congress, Dr. Lily Thapa, the coordinator of the ‘Bhadra 23 and 24 Movement Investigation Committee’ and a member of the commission, clarified that it has not been possible to ascertain who fired the shots or from where they originated. She emphasized that excessive force was used during the protests. Although the commission has identified the technical details of the ammunition used, based on ballistic and forensic reports, it has faced challenges in identifying the shooter.

The forensic report obtained during the investigation was analyzed by the commission’s own expert, Dr. Harihar Wasti. According to him, most of the bullets that hit the protesters were found to have struck above the chest and abdomen. He stated, “The challenge was related to the forensic report. After receiving the report, we also involved our own expert. Our forensic specialist analyzed it and prepared the report. Dr. Harihar Wasti’s report mentions that most bullets hit above the chest and abdomen. However, we have not been able to determine who fired those bullets or from where they came, whether from the STF or elsewhere. That was a significant challenge. We can only say that excessive force was used. Our investigation was based on two foundations. First, it was conducted according to the commission’s mandate. Second, we studied not only the events of the 23rd but also subsequent incidents. We examined events up to the 25th. Incidents involving gunfire during escapes from jails and juvenile correction centers in Dhading, Banke, and Naubasta on the 24th and 25th were also included in the report. We have ballistic reports, forensic reports, and other related documents. These reports provide details on the caliber of bullets used. However, it remains unclear who fired the shots. Nevertheless, we have concluded that the shots were fired from within. The STF was stationed at the frontline in the area towards the Parliament building, but it is not clear who fired from there. Our report clearly states that shots were fired indiscriminately. Even in situations requiring force, the principle of aiming below the knee was not followed. This is mentioned in the report, and you have also read it.”

The report indicates that although the STF was stationed at the frontline and shots were fired from the Parliament area, it remains uncertain who fired the shots. However, the commission has concluded that the shots were fired from within the protesters’ perimeter. The report points out serious errors by the security forces. It concludes that the global standard and legal principle of aiming below the knee when using force in special circumstances were not adhered to by the security mechanism.
